In consideration of our membership at Forest Hills Swim Club (“Forest Hills”), we, on our behalf and on behalf of our children and relatives, hereby agree to the following:
We and our children and relatives agree to abide by all of the rules and regulations of Forest Hills, which may be posted, issued orally, or otherwise published. These rules may be amended at the club’s discretion without notice. We agree that neither we nor our family will engage in behavior injurious to the enjoyment of Forest Hills by other members. We understand and agree that our and our family’s use of Forest Hills may be immediately terminated if any behavior is not in accordance with the above.
We agree and understand that the use of the facilities of Forest Hills may involve vigorous physical exercise, including by way of example, swimming, diving, exercise and prolonged or peak physical activity, as well as use of recreational equipment or other devices located at the premises. The undersigned understand that there are significant risks with participation in the activities at Forest Hills, including by way of example, the possibility of serious injury or death caused by falling, exertion, physical activity, drowning, accident, injury related to use of equipment or devices, or injury caused by or inflicted by the acts or negligence of
other participants.
We assume full responsibility for all risk of bodily injury, sickness, death, or property damage arising out of or related to the use of the facilities at Forest Hills, whether caused by the negligence, gross negligence, or other conduct by any officer, director, employee, agent, or representative or Forest Hills, and do hereby release, waive, discharge, and covenant not to sue Forest Hills and its officers, directors, employees, agents, and representatives from any and all liability that they may or can have for any loss or damage to property or person on account of, arising out of, or related to their use of these facilities at Forest Hills.
